Al Moatamer App – Terms and Conditions
Welcome to the Al Moatamer App, the electronic platform officially recognized by “Nusuk” and the Ministry of Hajj and Umrah. Al Moatamer App is an electronic tool that facilitates communication between service providers and customers in the Kingdom of Saudi Arabia in accordance with local laws. The App is owned by Al Moatamer for Commercial Services, headquartered in Makkah, with Commercial Registration number (4031077736) dated 30/8/1442H

1 Definitions
1.1 “Agreement” refers to these Terms and Conditions and the Privacy Policy, collectively forming the legally binding contract between the Al Moatamer App and its users
1.2 “Al Moatamer” or “the App” or “the Website” or “We” or “Our” refers to the Al Moatamer App, the website www.almoatamer.com, and Al Moatamer for Commercial Services
1.3 “Muwakkil” means any Muslim who wishes to appoint someone else to perform Umrah on his/her behalf
1.4 “Umrah Performer by Proxy” or “Performer” or “User” or “You” or “Your” means any Muslim who uses the Al Moatamer App to perform Umrah on behalf of those who request it
1.5 “Third Parties” refers to all individuals and entities that we do not control and are not under our supervision
1.6 “Laws” refers to the applicable laws in the Kingdom of Saudi Arabia
2 Description of Services
2.1 The App serves as an electronic intermediary for performing Umrah, allowing individuals who cannot perform Umrah to connect with performers willing to fulfill Umrah on their behalf
2.2 The client (Muwakkil) can track the performer’s steps from the starting point until the completion of the Umrah rituals, in accordance with the Prophetic Sunnah
3 Conditions for the Muwakkil
3.1 This Agreement constitutes an electronic contract between the App and all its users, replacing all previous oral or written agreements
3.2 This Agreement is subject to continuous modifications and updates to align with the services provided by Al Moatamer, and users are responsible for reviewing it periodically to stay updated on any changes
4 Terms of Joining the Agreement
4.1 The user must be legally eligible to enter into this Agreement and must be at least 18 years old If the user is under 18, he/she must join through a legal guardian or custodian
4.2 The user must fully read the provisions of this Agreement before joining
5 Legal Notices
5.1 Legal notices shall be sent through the communication methods provided by the user, including phone calls, text messages, or emails
5.2 The user acknowledges waiving any legal rights to receive written notices from Al Moatamer
6 Account Terms
6.1 The performer must create an account on the App with accurate and complete information, including name, email address, bank account details, and a copy of the national ID or residency permit
6.2 The performer is prohibited from registering more than one account If duplication is discovered, all associated accounts will be deleted
7 Terms of Use
7.1 The App must be used lawfully and in accordance with the purposes stated in these Terms or as announced on the App’s pages
7.2 The user must safeguard the reputation of the App and must not tarnish it directly or indirectly
8 Content Policy
8.1 Content is provided through the Al Moatamer App for informational purposes only and for the sole purpose of delivering services
8.2 The user must verify the accuracy and correctness of the content available through the App
9 Terms for the Umrah Performer by Proxy
9.1 The performer must be a Saudi national or a legally recognized resident in the Kingdom
9.2 The performer must be registered on “Tawakkalna” and “Eatmarna” apps and must be immunized with approved vaccines against coronavirus
9.3 The performer must perform the Umrah in accordance with the Prophetic Sunnah and must not commit any religious violations
10 Payment Mechanism
10.1 Deposited amounts are transferred to the service provider on a weekly basis, once the order fulfills all requirements stated in this Agreement and is properly completed
10.2 A commission of SAR 50 is deducted from each order before transferring the remaining amount to the performer
10.3 The performer bears any fees associated with providing the service or transferring funds, and Al Moatamer reserves the right to deduct these fees before transferring the amount to the performer
11 Cancellation Policy
11.1 The Muwakkil cannot cancel the order after it has been submitted
11.2 The performer is entitled to cancel before performing the “Umrah intention” Once the intention is made, the performer no longer has the right to cancel
12 Third Party
12.1 We may engage third parties in providing our services The App disclaims any liability for errors by these third parties and does not guarantee that the services are free from mistakes or delays
13 Intellectual Property Rights
13.1 All contents and trademarks of the App are owned by Al Moatamer for Commercial Services They may not be copied, imitated, or exploited in any form without prior permission
14 Legal Liability
14.1 Each performer is personally responsible for all actions they undertake through the App
15 Disclaimer of Liability
15.1 The client disclaims the App from any unlawful activities that may occur through it
15.2 The App assumes no responsibility for any direct or indirect damage resulting from use, inability to use, or from errors or negligence by the performer or any third party
16 Communications and Notifications
16.1 Communications with users are made through the contact details they have provided
16.2 Users are considered notified once the App has sent the notification through any contact method registered with us
17 Amendments and Additions
17.1 Al Moatamer reserves the right to modify or update these Terms and Conditions at any time without prior notice
17.2 The user is responsible for periodically reviewing these Terms to stay informed of any updates
18 Cancellation
18.1 The App reserves the right to cancel or modify any of the services or these Terms and Conditions without the user’s consent
19 Privacy and Confidentiality
19.1 The user is obligated to maintain the confidentiality of information and must not collect or exploit the data of third parties for any unlawful purpose
19.2 The App respects the confidentiality of all data provided by the user or related to the user’s activities through the App in accordance with our Privacy Policy
20 Location Permissions and Use
20.1 The App requires access to your device’s location to track Umrah journeys, provide navigation services, and assist in emergencies, and the user must consent to such access
21 Governing Law
21.1 The interpretation and enforcement of the clauses in this document shall be governed by the laws in force in the Kingdom of Saudi Arabia
22 Jurisdiction
22.1 Saudi courts have the exclusive jurisdiction to hear any disputes arising in connection with the interpretation or enforcement of the clauses of this Agreement
23 Compensation
23.1 The Umrah performer by proxy is held legally liable in the event of breaching any obligations stated in this Agreement and must compensate for any damages caused to the App or any third party
24 Arabic Language
24.1 This document has been drafted in Arabic which is the official version used in all legal proceedings In the event of any discrepancy between the Arabic text and any translation, the Arabic text shall prevail
25 Term of the Agreement and Withdrawal
25.1 This Agreement comes into effect from the date the user’s data is registered on the App and remains in effect unless terminated as stipulated in these Terms
25.2 Either party may terminate this Agreement according to the procedures set out herein subject to any financial or legal obligations that remain in effect prior to termination
